The following terms shall be deemed to be incorporated as conditions of sale entered into by the FIRM and the CUSTOMER. The Customer is the party named on the quotation and invoice and shall include their servant, agent and/or their nominee. The singular shall include the plural and vice-versa. The Firm shall be FAR EAST EUROPE LTD, FAR EAST INDUSTRIES LTD or FAR EAST LONDON LTD, as detailed on the quotation and invoice.

  1. All descriptive specifications are approximate only, The Firm reserves the right to make reasonable changes; modify specification and/or finish without notice.
  2. Unless otherwise stated, the prices quoted in the sale agreement have not included any building or electrical work.
  3. It is the Customer’s responsibility to provide suitable services; for example, gas, electricity, water and waste pipes are available in the kitchen area within 2 metres of where the equipment is to be installed before instructing The Firm to carry out the installation, unless otherwise agreed by The Firm in writing.
  4. The Customer agrees to pay for any extra costs incurred by The Firm if the Customer prevents The Firm from completing the installation, not withstanding any reason thus causing The Firm extra visits to site to complete the installation.
  5. A DEPOSIT MAY BE REQUIRED FROM THE CUSTOMER TO CONSTITUTE THEIR ACCEPTANCE OF THE AGREEMENT (typically 50%, refer to the quotation for exact deposit required). A FURTHER PAYMENT MAY BE REQUIRED FOR AN ON-SITE DATE TO BE BOOKED (refer to the quotation). THE BALANCE MUST BE PAID ON DELIVERY OR DAY OF INSTALLATION WHICHEVER IS THE LATTER.
  6. A 2% per month interest rate will be charged to the Customer on all overdue amounts, and any costs incurred in obtaining settlement. Dishonoured cheques are regarded as non-payment.
  7. Once the order is placed, it is subject to a 25% restocking charge for any item cancelled or changed (minimum charge £20). If the goods have already been delivered to the Customer, they must be returned at the customer’s expense and in original packaging, items which have been unpacked cannot be returned. Without prejudice to any other remedies we may have upon cancellation of an item or order for specially commissioned items the Customer agrees to pay any costs we have incurred at the time of cancellation (up to the full value of the item) plus the cancellation charge detailed above. If the Customer was advised by The Firm or a representative that an item was unsuitable prior to ordering the right to any refund is forfeited.
  8. All goods must be inspected immediately upon arrival. No claim for damage and/or shortage can be accepted by The Firm unless the Customer records it on the carrier consignment note at the time of delivery, and notify The Firm in writing within 3 working days of the date of delivery.
  9. Unless the Customer gives notice in writing to The Firm of any complaint within 14 days after the date of invoice, the Customer shall be deemed to accept the goods and/or service in proper order in all respects.
  10. The Firm reserves the right to subcontract any or all of its services to another party, but the contract for supply of those services will remain between The Firm and the Customer. Attendance at the Customer’s premises by any subcontractors will be as representatives of The Firm.
  11. All equipment manufactured by The Firm is subject to 12 month’s warranty provided that any breakdown is due to a manufacturing and/or installation fault by The Firm and not misuse (please refer to the products user manual for full terms and conditions of the warranty). In the case of goods not manufactured by The Firm, our liability shall be limited to such guarantee as provided by the manufacturer of the equipment (where manufacturer’s warranty covers parts only, labour shall be borne by the Customer).
  12. Any act of tampering and/or mishandling of the goods by the Customer will void the warranty and therefore any call out required will be chargeable to the Customer. The Firm reserves the right to suspend any warranty if payment or part thereof remains in arrears.
  13. All goods delivered by The Firm to the Customer will remain the absolute property of The Firm until full payment has been received. The Customer shall remain a custodian only until full payment is made. The default of any payment by the Customer will give The Firm or its representatives the right to enter the Customer’s premises and remove the goods not withstanding that damage may be caused in so doing to the Customer’s premises.
  14. The Firm supply and/or install equipment according to the Sale Agreement only, and in no way whatsoever shall The Firm be involved in any disputes with a third party (such as the Customer’s landlord, vendor, builder, neighbour or local authority etc). The Customer cannot use such disputes as an excuse to default on payment or part thereof.
  15. Gas pipework shall be tested for satisfactory soundness (tightness test by means of pressure drop measurement) by Far East before they commence any gas works. Any leaks discovered before or after gas works shall be the responsibility of the Customer.
  16. Save in respect of personal injury or death due to the negligence of The Firm, The Firm shall not be liable to the Customer for any loss suffered by the Customer due to defects in the goods. Without prejudice, The Firm shall not be liable to the Customer or any third party for loss of profit, consequential or other economic loss suffered by the Customer arising in any way from this agreement. Save in respect of personal injury or death due to the negligence of The Firm, the liability of The Firm under these conditions shall not exceed the price.
  17. The Firm shall not be liable for any default or delay due to any circumstances beyond the reasonable control of The Firm, including but not limited to, acts of God, war, civil unrest, riot, strike, lockout, acts of civil or military authorities, fire, storm, flood, earthquake, or shortage of supply or failure to deliver by the suppliers of The Firm.
  18. The Customer is liable for loss or damage of any materials or equipment once delivered to site.
